Conformity guarantee.
Dutch law requires that every product matches its description and is fit for its purpose. For live plants, conformity means healthy at delivery and accurately described for light, care, and pet safety.

What the law provides.
Under Dutch law (Burgerlijk Wetboek, Art. 7:17), you are entitled to receive a product that conforms to the agreement — meaning it matches its description, is suitable for its intended use, and is of the quality you could reasonably expect.
For non-living goods, the standard legal conformity period is two years. For live plants, conformity is assessed at delivery — a plant that arrives healthy and accurately described meets the conformity requirement; a plant that arrives in poor condition does not.
Your statutory rights exist regardless of any commercial guarantee we offer or any limitation in these terms.
[P] Live plants
Special considerations.
Plants are living organisms. Normal variation in size, leaf pattern, and growth habit is expected and does not constitute non-conformity. The images on product pages are representative of the species, not the exact individual plant you will receive.
Non-conformity for plants includes: arriving dead or severely damaged, failing to match the described light requirement or care level, or being mislabeled for pet safety.
Plants that arrive dead or severely damaged are handled under our arrival policy, which offers a faster path than the standard conformity process.
[R] Reporting
How to report.
The planned reporting route is hello@brightnessbased.shop. Once ordering is live, a report should include:
- Your order number.
- A description of the non-conformity.
- Photos where relevant.
The operator must implement assessment and remedy handling before launch, including when a replacement or refund is appropriate for a live plant.
